importStylesheet errors

If I load a xsl stylesheet like
$dom->load('myStyleSheet.xsl');
if that style sheet uses and <xsl:include href="URI"/>
and then try to import use
$result= $proc->importStylesheet($dom);
I get errors such as
Opening and ending tag mismatch: xsl:stylesheet line 1 and xsl:template
Is there a way around this?
