I just upgrade from 5.1.6 to 5.2.0. On old PHP version it's working OK and on new version it's not working. PHP is used as mod_php on apache 2.2.3. Apache is not changed between PHP upgrade. I test it on two different servers with apache 2.2.3 and 2.0.59. So it's look like that there is some bad changes on new PHP 5.2.0. On php 5.1.6 it's working OK. If I try "include virtual" first php file and after htm file from directory with disabled php it's look like OK.
