my fault...i still used an incompatible version of eaccelerator which
caused the crash.

i just tried to open phpinfo(); .. and apache crashed tested as apache
module and as fcgi
when php is used as apache_module a small part of phpinfo is shown until
the "date" infoblock appears then php/apache crashes
With PHP 5.3.1 everything works fine.
Test script:

phpinfo();
?>
Expected result:
----------------
A full phpinfo page without crashing
Actual result:
--------------
php crashes
