nope its a directory
same configuration, same php scripts, same php.ini
5.3.10 works with no warnings
5.3.13 lots of open_basedir warnings
must be changed something in the php open_basedir implementation

it seems that the require statement does not correctly evaluate the allowed path
This issue is not present on php 5.3.10
