You really should be using php4.3-dev (latest unstable snapshot) if you
are going to be playing with Apache 2.0

Also, which mpm are you using for Apache2?

so far nothing has been changed if you look to the first comment.

:-( no dice newer gives the same fault. So now what the do? 
any suggestions?
