I tried the lastest STABLE snapshot
php4-STABLE-200210150300
and apache 2.0.43
the same... maybe it's apache's fault but I don't know
when I touch the script it works fine for a moment but it
gets confused again. No problems with apache 1.3.

I'm running redhat 8.0 with apache 2.0.40 and php 4.2.2
It seems that apache 2 replies to request for php-generated pages with
304 Not-Modified
when If-Modified-Since header is sent. Well, mostly. You need to hit
reload on your browser to get it reloaded (no If-Modified-Since sent).
I guess sending 304 header should be handled manually in the script
when needed, and not by Apache.
