I gave the code snippet a try here with a CGI SAPI version of PHP 4.2.2.
I wasn't able to reproduce the crash:
dave@united (~) $ echo -e '<?php\n$a = "";\n$a .=
<<<EOF\nEOF;\n?>' | php
Content-type: text/html
dave@united (~) $ php -m | grep -i running
Running PHP 4.2.2
