This worked for years because you were using Jade to process documentation. Jade is an SGML based tool which silently ignores this problem. But if you want to process documentation with some XML based tool - for example with XSLT processor and XSL DocBook stylesheet you need files which realy comforms to XML. I added encoding declaration to some files at the beginning of this year. I modified files which used some characters from iso-latin-1 (umlauts and so on).
