Help with fopen

Hi every one. Inew to this list but not to php.
Since php-4.3.0 I have the same problem that fopen("xxx","w") fails to
create a file event if the directory is 777. This happens with
safe_mode=On
I've search the archives and they all say the bug is corrected. It's not!
I'm running on uw 7.1.3 and now trying php-4.3.2.rc4 but I still have the
same bug.
I trussed the apache server while testing and found that the error is
reported after pathconf returns ENOENT because the file doesn't exist.
It doesn't seem that php group is willing to correct this bug since all
messages I read say this is corrected.
Can anyyone help with this? please cc your responses as I'm subscribed to
the disgerst list.
