Odd - I copy/paste the code below and run it against windows version of
php4.0.6 and it's okay
Maybe you've got a hidden char there somewhere?

and I get this error
Parse error: parse error, unexpected T_STRING, expecting '&' or T_VARIABLE
or T_CONST in D:\sid\sid-test\index.php on line 3
what is the problem here.
