you cannot have mod_php3 static and mod_php (i.e. 4) in the same
apache w/o compiling with --enable-versioning or something.
Recompile apache with static mod_php if you want, or just with mod_so
and --enable-shared=max, then configure php --with-apxs.

you also did AddModule mod_php4.c in httpd.conf, didn't you?
