Hansmove everything that could create errors in a separat method. if you have a factory method you can call this method from there after the object has been instanciated. Since this is a PHP5 issue, perhaps classes that do this (assuming it's for error purposes) should just branch for PHP5 & throw Exceptions. Seems like an easy solution.
