[QuickForm] require rule on one radio button

I have one radio button that I wanted the user to check for an agreement,
and when I set the following rule on it, even if I chek it it still gives me
the required javascript. Did I set the rule incorrectly?
$artist_app->addElement('radio', 'agree', 'I agree', NULL,
'agree' );
$artist_app->addRule('agree', 'You must agree to terms',
'required', null,
'client');
