I think every such case should be discussed on it's merits and decided
upon. Also, I'd put every thing when PHP is behaving in a consistent, sane
(like, not crashing or resulting in entire trash) but not expected way
(like closing tag in the comments) into "it's how it is in PHP but you can
ask for change and maybe convince us" department. If the behaviour is
outright wrong, then it's a bug.
