the PHP License is a contract that grants a contracting party
rights above and beyond the copyright law. In particular,
the license allows anyone agreeing to the terms of the license
to redistribute PHP. Without agreeing to the license,
redistributing PHP is illegal under most western copyright
statutes.
Now, if you aren't taking advantage of the special rights
granted by the PHP License, ie. you are not redistributing
PHP or any piece of code under the PHP License, you have no
obligation whatsoever to abide by the conditions set forth
in the license.
As phpMyAdmin (to name an example often mentioned in the
discussion) doesn't distribute any part of PHP, modified
or otherwise, there is nothing that can make them abide
by the sections 3 and 4 of the license.
The only potential protection the PHP Group has against
the use of the name "PHP" by projects that don't utilize PHP
source code is the trademark law. Someone from the group
can comment on the status of PHP trademarks in various
jurisdictions.
