There are several ways, but the easiest might be to set a hidden
value in a form, and change it with JavaScript. So something like
<SCRIPT language="Javascript">
// javascript to set field IsJS to "Y"
</SCRIPT>
Then in a form, have a hidden field called IsJS, and set it to "N".
I'm sure there are other ways. This was the first that came to
mind... of course, it doesn't help if the first page the user comes
to is one that might need to have JS on it.

You can't demand something as a "right" unless you are willing to fight to death to
defend everyone else's right to the same thing.
