I'm not sure what you're trying to do here, is this all code within php? If
so, then there shouldn't be a reason for you to start the <? tag for PHP.
It should be, as someone already said:
echo ("</FORM>" . include(\"footer.inc\") . "</HTML>");
I just learned something new, I didn't know you could comment with the #
character. :-)
