Win32 problems ./pear/tests directory

I have pear installed under c:\php, and managed to install packages etc.... but some packages are still putting their files in c:\php4\pear\tests\
I have checked pear.bat and pear.in and neither contain references to c:\php4 (both are from cvs a few days ago)
All packages that have these tags in the package.xml seem to be affected
