Ok after i removed the /usr/local/lib/php.ini file (which caused the error that session.auto_start wasnt enabled in this version) my sites on my test machines worked perfectly (using redhat 6.0 / apache 1.3.9 / php 4b3 RC3 / mysql 3.22.22). One thing i did notice is the higher memory consumption for php4 vs php3 . On my heaviest php based site (www.reviewboard.com) memory usage per httpd process went from 3.8 megs per process to 7.1 megs per process.
