Thus the rule is: There is no rule. The package.xml from CVS must not work or must be a valid package.xml file. Well, that makes it harder to help, because patches should be done from CVS versions [1]. Or for a normal user to use CVS versions from packages, because of solved bugs in CVS, but a new package is not currently released.
