I just checked in a change to the open_basedir check.  I don't think it
is a fix for your problems, but it could be.  

Please try using this CVS snapshot on a non-production machine:

One more Info: 
I was running apache1.3.26 + php-4.0.6 + mod_ssl-2.8.3-1.3.26 +
openssl-0.9.6b for a long time without any problems. The only thing I
changed was an upgrade to openssl-0.9.6g.

I still have these random errors, but there is better with patch than
without patch. I have about few errors per hour at the server with
1MB/s traffic.
